Challenging Home Office Refusal Decisions – Appeal – Admin Review - JR

You can challenge the Home Office UKVI refusal decision if your immigration application has been refused and you believe the refusal decision to be unlawful.

We can appeal to the courts if the Home Office has decided to refuse your protection claim, ‘asylum claim’ or ‘humanitarian protection’; revoke your protection status; refuse your human rights claim; refuse you a residence document or deport you under the Immigration (European Economic Area) Regulations 2016; revoke your British citizenship; refuse or revoke your status, vary the length or condition of your stay, or deport you under the EU Settlement Scheme among others.

Administrative Review (AR)

An Administrative Review (AR) is a review or reconsideration of your immigration application following refusal of the same by the Home Office, UKVI.

Pre Action Protocol (PAP)

A pre-action protocol (PAP) letter can be sent to the Home Office UKVI before filing a Judicial Review application and ask UKVI to reconsider its refusal decision.

Judicial Review (JR) In The Upper Tribunal (UT)

You can challenge certain immigration refusal decisions by Judicial Review (JR) to the Upper Tribunal (UT) if you have not been given right of appeal.
