Appendix UK/European Applicant Transfer Scheme (APP UEATS1)
Appendix UK/European Applicant Transfer Scheme is being added to the Rules. It sets out, eligibility, method of application, requirements to meet for successful grant of application.
Under the Scheme the SSHD will transfer limited number of people from France to the UK. This Scheme will only open to applicants in France. Total number of people transferred to the UK will correlate with the number of people removed from the UK under the pilot arrangement on the prevention of dangerous journeys.
Applicants to UEATS1 must be aged 18 or over at the time application is submitted, unless they are applying as part of a family member who is over the age of 18.
The Scheme permits adults and family (parents and children) from all nationalities (except EEA nationals or their family members) to submit expression of interest.
It’s a two stage application process. First, an expression of interest application must be submitted. There is a window for submitting Expression of Interest. SSHD will determine the Expression of Interest Window. Application submitted outside of the EoI window will be rejected.
Upon receipt of EoI Application, the Home Office will decide which applications will proceed to Entry Clearance application, based upon the criteria set out in the Home Office Guidance for the Scheme. Any outstanding Expression of Interest application when pilot closes will be rejected.
When EoI applications is selected, the HO will complete an Entry Clearance application on behalf of the applicant. Entry Clearance applications will be considered in accordance with the requirements in the Rules.
The Scheme will close when SSHD assess that the volume of return applicants is met. Scheme cannot be used to apply for leave outside the Rules.
Definitions
“A family group" means two or more applicants related to one another as a parent, child or partner, who have confirmed on their EoI App that they are applying with other family members.
“Family Reference Number” means the reference given to an applicant who applies first and indicates that they are applying as part of a family group. The family reference number is provided by all other family members for the purpose of their main application.
“the Cap” means the total number of individuals removed from the UK through the pilot arrangement on prevention of dangerous journeys at the end of the pilot period.
“Application Window” means a period determined by the SSHD, in which the EoI Apps may be submitted under the UEATS, having regard to the need to meet the cap.
Void Applications
An EoI App will be void if a person has previously submitted an EoI Application and any of the following apply:
a) It was rejected because the applicant was outside France; or
b) The stated family unit applying has changed between the two applications (except the change is due to birth or death of the family member); or
c) Entry clearance was refused.
Applicant cannot make Multiple active applications. Where multiple applications are made, only one will be considered.
Failure to provide biometrics will void the application.
If an applicant of EoI, travels to and enters the UK without permission, their application will be void.
Validity Applications
EoI applications must be submitted online using the specified form and register for EoI scheme.
Applicant must be in France when application is submitted.
EoI must meet the following requirements:
a) The applicant must be aged 18 or over on the date of application, except when they are part of the family group, where parent is over 18; and
b) The applicant cannot be an EEA national or enjoy free movement rights as a family member of an EEA national; and
c) The applicant for an EoI must upload their passport or other ID documents with a recent photograph to satisfactorily establish their identity and nationality; and
d) The EoI application must be submitted within the application window; and
e) The applicant must not have been granted international protection by another country, including accepted as a stateless person; and
f) The applicant must not have immigration permission in France; and
g) The applicant must not have declared any information that could lead to a refusal under Part 9: grounds of refusal.
Applicant applying first as part of a family group must:
a) Confirm on their EoI App that they are applying as part of a family group; and
b) Have listed names of all other family members applying as part of the family group; and
c) Provide satisfactory evidence of family relationships to the group.
Application which does not meet the validity requirements will be rejected as invalid.
If EoI app as part of the family group is rejected as invalid all linked applications will also be rejected.
Application for Entry Clearance
Application for Entry Clearance must meet all the following requirements:
a) Applicant must have provided biometrics; and
b) Applicant must have provided passport or other id documents which satisfactorily establish their identity and nationality.
EoI application submitted after the cap has been reached will be rejected.
If an EoI application has not been selected for Entry Clearance consideration, at the point when cap is reached, will be rejected.
Suitability Requirements
Applicant must not fall for refusal under Part-9: Grounds for refusal
Applicant must not have previously entered or arrived in the UK illegally.
Entry Clearance application eligibility requirements
The applicant must not have been granted international protection in another country since submitting their EoI Application.
The applicant must not have immigration status in France.
Decision
An application which does not meet the suitability or eligibility requirements will be refused.
If entry clearance family group application is refused it will be refused for all linked applications within the group.
If the cap is reached before Entry Clearance is granted, the EC application will be refused.
Cancellation of permission
Permission may be cancelled if:
a) The applicant ceases to meet the requirements under which EC was granted; or
b) The applicant does not present for travel to the UK, without reasonable excuse, when directed by the Home Office; or
c) The applicant does not collect their visa, without reasonable excuse, when directed by the Home Office; or
d) The applicant has been granted international protection elsewhere; or
e) It is discovered that the applicant has immigration status in France when they applied for and were considered under the scheme.
Period and Conditions of Entry
The applicant will be granted entry clearance to come to the UK for a period of three months.
Entry will be subject to the following conditions:
a) No access to public funds; and
b) No work permitted; and
c) No study is permitted.
Travel document
Applicant granted permission under the UEAT Scheme will be issued with a travel document to travel to the UK.
